When I was stationed at Camp Pendleton I was in Weapons Company 3/5. The unit made us t-shirts with the 3/5 logo/emblem/crest, "Consumate Professionals". I was honorable discharged in 1999 and the t-shirt has been long-gone. I searched a couple of web site to find a shirt with the logo/emblem/crest but there was no luck. It didn't take me long to search this site before I found what I was looking for. When the shirt arrived it was better than what I expected. I love the t-shirt and wear it with pride and often. Thank you for being so prompt with my order, and the refund as well.

I thought a little constructive thoughts were in order.

The "HRT" boot knife is well constructed. I had to "hone" the edge though, both sides,to get it up to spec.

As for the "GI USMC Combat Knife"......Well, it wasn't really a K-Bar, at least not one that I've ever seen. It read "US", and above that it read "Ontario". No worries though, after I used a ceramic sharpening stone on both the small back edge and the full length edge, I'm quite pleased with them both. Oh, I almost forgot, both were very pretty well balanced.

I'll be purchasing again from you in the near future.

Where Have All Our Leaders Gone?
It's up to the People.

In my life time I have never seen so much uncertainty for the future of freedom in our country and I do right now. Our politicians and bureaucrats are self serving, acting with the mentality of dictators and tyrants. Leadership seems almost non-existent, something we surely need to inspire and motivate our nation to preserve freedom and bring back honor to the people.

I see many silent heroes that are carrying on as best they can to fulfill their responsibilities and some not bogged down in day to day survival getting out to the tea parties, rallies and town hall meetings voicing their concerns, wondering what happened to our Constitution.

But what I have yet to see is a great leader arise. So I looked back into the past where the key to the future always lies and the Fathers of our country probably the greatest American of all stood out to me. I wanted to share this thought and story with you hoping the role model George Washington will for future generations inspire Americans again.

Down through the ages, military organizations have employed various types of standards or guides for soldiers to follow amidst the confusion of battle. I feel the character and actions of George Washington should serve as our standard and role model to define all Americans and our flag the "Stars and Stripes" should serve as our guide for the American dream, to follow the colors and uphold the traditions, the right to life, liberty and the pursuit of happiness; to secure these rights, governments are instituted among men deriving their just power from the consent of the governed. To uphold these traditions to victory in both our personal and collective fight to preserve the legacy of freedom bought in blood by those before us.

The Battle of Trenton

And such they are‚ and such they will be found

Not so Leonidas and Washington,

Their every battle‚ field is holy ground

Which breathes of nations saved, not worlds undone.

How sweetly on the ear such echoes sound!

While the mere victor's may appall or stun

In December, 1776, the American Revolution was at its lowest ebb. The first burst of enthusiasm, which drove the British back from Concord and meet them hand to hand at Bunker Hill, which forced them to abandon Boston and repulsed their attack at Charleston, had spent its force. The undisciplined American forces called suddenly from the workshop and the farm had given way, under the strain of a prolonged contest, and had been greatly scattered, many of the soldiers returning to their homes.

The power of England, on the other hand, with her disciplined army and abundant resources, had begun to tell. Washington, fighting stubbornly, had been driven during the summer and autumn for Long Island up the Hudson, and New York and passed into the hands of the British. Then Forts Lee and Washington had been lost, and finally the Continental army had retreated to New Jersey.

On the second of December Washington was at Princeton with some three thousand ragged soldiers, and had escaped destruction only by the rapidity of his movements. By the middle of the month General Howe felt that the American army, unable as he believed either to fight or to withstand the winter, just soon dissolve, and posting strong detachments at various points, he took up his winter quarters in New York. The British general had under his command in his various divisions' twenty-five thousand well-disciplined soldiers, and the conclusion he had reached was not an unreasonable one; everything, in fact, seemed to confirm his opinion.

Thousands of the colonists were coming in and accepting his amnesty. The American militia had left the field, and no more would turn out, despite Washington's earnest appeals. All that remained of the American Revolution was the little Continental army and the man who led it.

Yet even in this dark hour Washington did not despair. He sent in every direction for troops. Nothing was forgotten. Nothing that he could do was left undone. Unceasingly he urged action upon Congress, and at the same time with indomitable fighting spirit he planned to attack the British.

It was a desperate undertaking in the face of such heavy odds, for in all his divisions he had only some six thousand men, and even these were scattered. The single hope was that by his own skill and courage he could snatch victory from a situation where victory seemed impossible. With the instinct of a great commander he saw that his only chance was to fight the British detachments suddenly, unexpectedly, and separately, and to do this not only required secrecy and perfect judgment, but also the cool, unwavering courage of which, under such circumstances, very few men have proved themselves capable.

As Christmas approached his plans were ready. He determined to fall upon the British detachment of Hessians, under Colonel Rahl, at Trenton, and there strike his first blow. To each division of his little army a part in the attack was assigned with careful forethought. Nothing was overlooked and nothing omitted, and then, for some reason good or bad, every one of the division commanders failed to do his part. As the general plan was arranged, Gates was to march from Bristol. With two thousand men; Ewing was to cross at Trenton; Putnam was to come up from Philadelphia; and Griffin was to make a diversion against Donop. When the moment came, Gates who disapproved the plan, was on his way to Congress; Griffen abandoned New Jersey and fled before Donop; Putnam did not attempt to leave Philadelphia; and Ewing made no effort to cross at Trenton. Cadwalader came down from Bristol, looked at the river and the floating ice, and then gave it up as desperate. Nothing remained except Washington himself with the main army, but he neither gave up, nor hesitated, nor stopped on account of the ice, or the river, or the perils which lay beyond.

On Christmas Eve, when all the Christian world was feasting and rejoicing, and while the British were enjoying themselves in their comfortable quarters, Washington set out. With twenty-four hundred men he crossed the Delaware through the floating ice, his boats managed and rowed by the sturdy fishermen of Marblehead from Glover's regiment. The crossing was successful, and he landed about nine miles from Trenton. It was bitter cold, and the sleet and snow drove sharply in the faces of the troops. Sullivan, marching by the river, sent word that the arms of his soldiers were wet. "Tell your general," was Washington's reply to the message, "to use the bayonet, for the town must be taken."

When they reached Trenton it was broad daylight. Washington, at the front and on the right of the line, swept down the Pennington road and as he drove back the Hessian pickets, he heard the shout of Sullivan's men as, with Stark leading the van, they charged in from the river. A company of jaegers and of light dragoons slipped away. There was some fighting in the streets, but the attack was so strong and well calculated that resistance was useless. Colonel Rahl, the British commander, aroused from his revels, was killed as he rushed out to rally his men, and in a few moments all was over. A thousand prisoners fell into Washington's hands, and this important detachment of the enemy was cut off and destroyed.

The news of Trenton alarmed the British, and Lord Cornwallis with seven thousand of the best troops started at once from New York in hot pursuit of the American army. Washington, who had now rallied some five thousand men, fell back, skirmishing heavily, behind the Assunpink, and when Cornwallis reached the river he found the American army awaiting him on the other side of the stream. Night was falling, and Cornwallis, feeling sure of his prey, decided that he would not risk an assault until the next morning. Many lessons had not yet taught him that it was a fatal business to give even twelve hours to the great soldier opposed to him. During the night Washington, leaving his fires burning and taking a roundabout road which he had already reconnoitered, marched to Princeton. There he struck another British detachment. A hundred men, and Washington withdrew after this second victory to the highlands of New Jersey to rest and recruit.

Frederick the Great is reported to have said that this was the most brilliant campaign of the century. With a force very much smaller than that of the enemy, Washington had succeeded in striking the British at two places with superior forces at each point of contact. At Trenton he had the benefit of a surprise, but the second time he was between two hostile armies. He was ready to fight Cornwallis when the latter reached the Assumpink, trusting to the strength of his position to make up for his inferiority of numbers. But when Cornwallis gave him the delay of a night, Washington seeing the advantage offered by his enemy's mistake, at once changed his whole plan, and, turning in his tracks, fell upon the smaller of the two forces opposed to him, wrecking and defeating it before the outgeneraled Cornwallis could get up with the main army.

Washington had thus shown the highest form of military skill, for there is nothing that requires so much judgment and knowledge, so much certainty of movement and quick decision, as to meet a superior enemy at different points, force the fighting, and at each point to outnumber and overwhelm him.

But the military part of this great campaign was not all. Many great soldiers have not been statesmen, and have failed to realize the political necessities of the situation.

Washington presented the rare combination of a great soldier and a great statesman as well. He aimed not only to win battles, by his operations in the field to influence the political situation and affect public opinion. The American Revolution was going to pieces. Unless some decisive victory could be won immediately, it would have come to an end in the winter of 1776‚ 77.

This Washington knew, and it was this which nerved his arm. The result justified his forethought. The victories of Trenton and Princeton restored the failing spirits of the people, and, what was hardly less important produced a deep impression in Europe in favor of the colonies. The country, which had lost heart, and become supine and almost hostile, revived. The militia again took the field. Outlying parties of the British were attacked and cut off, and recruits once more began to come into the Continental army. The Revolution was saved.

That the English colonies in North America would have broken away from the mother country sooner or later that cannot be doubted, but that particular Revolution Of 1776 would have failed within a year, had it not been for Washington.

It is not, however, merely the fact that he was a great soldier and statesman which we should remember. The most memorable thing to us, and to all men, is the heroic spirit of the man, which rose in those dreary December days to its greatest height, under conditions so adverse that they had crushed the hope of every one else. Let it be remembered, also, that it was not a spirit of desperation or of ignorance, a reckless daring which did not count the cost. No one knew better than Washington‚ no one, indeed, so well‚ the exact state of affairs; for he, conspicuously among great men, always looked facts fearlessly in the face, and never deceived himself. He was under no illusions, and it was this high quality of mind as much as any other which enabled him to win victories.

How he really felt we know from what he wrote to Congress on December 20, when he said: "It may be though that I am going a good deal out of the line of my duty to adopt these measures or to advise thus freely. A character to lose, and estate to forfeit, the inestimable blessing of liberty at stake, and a life devoted, must be my excuse." These were the thought in his mind when he was planning this masterly campaign. These same thoughts, we may readily believe, were with him when his boat was making its way through the ice of the Delaware on Christmas Eve. It was a very solemn moment, and he was the only man in the darkness of that night who fully understood what was at stake; but then, as always, he was calm and serious with a high courage which nothing could depress.

The familiar picture of a later day depicts Washington crossing the Delaware at the head of his soldiers. He is standing up in the boat, looking forward in the teeth of the storm. It matters little whether the work of the painter is in exact accordance with the real scene or not. The daring courage, the high resolve, the stern look forward and onward, which the artist strove to show in the great leader, are all vitally true. For we may be sure that the man who led that well‚ planned but desperate assault, surrounded by darker conditions than the storm of nature which gathered about his boat, and carrying with him the fortunes of his country, was at that moment one of the most heroic figures in history.

Good afternoon. My name is Brian, Sergeant, United States Marine Corps. I'm currently a Platoon Sergeant in the Infantry with 2nd Battalion 6th Marines. I've done 3 combat tours to Iraq and 1 MEU. We are currently on a work up to deploy to Afghanistan spring/summer of 2010. On 8 August, 2005, my life changed forever. For on that day, my warrior, my hero, my son - SSG Chris Falkel - was killed in action in the 54 hour Battle of Mari Ghar in Afghanistan. Chris was a weapons sergeant on ODA 316 of 3rd Special Force Group (Airborne). In the fifth of seven battles, Chris was killed by a sniper's bullet while he was doing all he could to save the lives of his teammates. For his valor and professionalism, SSG Chris Falkel was awarded the Silver Star.

There is a hole in my heart that will never heal. But I have a tremendous family, my Special Forces family, that has done more for me that I can possibly describe in mere words. They have been my shield. They have shared their love of Chris and of me. They have given my life a new direction.

And that direction has been to not only honor my son, but to help honor and to ALWAYS remember the sacrifice of our fallen heroes and their families. The first project I started was Junior's Bullet Pen Company - www.juniorsbulletpens.com . Chris was called "Junior" by his teammates, and as a weapons sergeant, he was always making things out of bullet shell casings. However, the one thing he really wanted to make out of shell casings, but never figured out how to do it, was to make a pen out of a bullet. I was able to figure it out, and so we started Junior's Bullet Pen Company. Proceeds from the sales of every bullet pen go to the Special Operations Warrior Foundation - the Foundation that provides college scholarships for the children of our fallen Special Operations Warriors. Chris was only 22 when he crossed over, and did not have any children, but he always supported the Special Operations Warrior Foundation, and so we have continued our support of this amazing Foundation - www.specialops.org

The second project I started began the day after I heard of Chris' death. I started writing down stories of my amazing son, and three years later, we published The Making of OUR Warrior. It is a story of love - a father's love, a son's love, and a team's love. It is the story of OUR family. And while writing it was the hardest thing I have ever done, it is probably my greatest work. It was incredibly therapeutic for me. So, after talking with OUR family, and one of my dearest friends, Dr. Jim Peterson, we started the More Than A Name Foundation - a Foundation dedicated to telling the stories of our fallen heroes, telling the world that these patriots are indeed more than just a name. We are also working on a very special project right now. On 16 March 2009 (3-16), SSG Chris Falkel Drive was dedicated in our town, along with SGT Jon Stiles Drive to honor Army Sergeant Jon Stiles that was killed in Afghanistan last year. It was one of the best days I have had since 7 August 2005. I want other families of heroes to feel the same way. I want the people of our towns to recognize and NEVER forget the sacrifice of our fallen heroes, and not just those in the military, but all the first responders that have given their lives for their neighbors and their communities.

So, the Streets for Sacrifice Project is working to develop an "SOP - Standard Operating Procedure" or template so that EVERY town in our great country that has lost a fallen hero can dedicate a street to that courageous person, and every time someone drives down that street, they will see the name, and realize that that person gave their life so that we can enjoy the freedoms we have. We hope to get our SOP out to every town in our country that has lost a hero in the next couple of months.

Thank you for the opportunity of sharing with you, and I especially want to thank Dave at Special Forces Gear for not only all he has done for me, but for all of OUR Special Forces family!


Boeing does it again!

3 Carrier Groups and Boeing 797 - A New Way To Fly The plane in these pictures is still officially the 'Air Vehicle Number 1', a prototype, on board the USS George Washington CVN-73 for catapult fit checks.  Not exactly still

Top Secret but certainly not yet made public.

It will be known as the F/A-37.  Although specs are classified, it is believed to be Mach 3.5 (top speed in the Mach 4 range) super-cruise stealth fighter/bomber/interceptor with approximately a 4,000nm range.  Awesome!

For the first time in over 20 some odd years, three carrier strike groups got together in formation for a great photo op.

From top to bottom are the aircraft carriers, ABRAHAM LINCOLN, KITTY HAWK and RONALD REAGAN.

We even had Air Force planes fly-over, see the B-2 Stealth Bomber in the fifth & seventh picture down.  The only warships not seen in the photos are the 4 nuclear powered submarines standing guard.

Look at this new aircraft...

Boeing is preparing a 1000 passenger jet that could reshape the Air travel industry for the next 100 years. The radical Blended Wing design has been developed by Boeing in cooperation with the NASA Langley  Research Center.

The mammoth plane will have a wing span of 265 feet compared to the 747's 211 feet, and is designed to fit within the newly created terminals used for the 555 seat Airbus A380, which is 262 feet wide.

The new 797 is in direct response to the Airbus A380 which has racked up 159 orders, but has not yet flown any passengers. Boeing decide to kill its 747X stretched super jumbo in 2003 after little interest was shown by airline companies, but has continued to develop the ultimate Airbus crusher 797 for years at its Phantom Works research facility in Long Beach, Calif.

The Airbus A380 has been in the works since 1999 and has accumulated $13 billion in development costs, which gives Boeing a huge advantage now that Airbus has committed to the older style tubular aircraft for decades to come.

There are several big advantages to the blended wing design, the most important being the lift to drag ratio which is expected to increase by an amazing 50%, with overall weight reduced by 25%, making it an estimated 33% more efficient than the A380, and making Airbus's $13 billion dollar investment look pretty shaky...

High body rigidity is another key factor in blended wing aircraft. It reduces turbulence and creates less stress on the air frame which adds to efficiency, giving the 797 a tremendous 8800 nautical mile range with its 1000 passengers flying comfortably at mach 0.88 or 654 mph (+-1046km/h) cruising speed another advantage over the Airbus tube-and-wing designed A380's 570 mph (912 km/h).

The exact date for introduction is unclear, yet the battle lines are clearly drawn in the high-stakes war for civilian air supremacy.

What an amazing thing!

USS New York... It was built with 24 tons of scrap steel from the  World Trade Center.

It is the fifth in a new class of warship - designed for missions that include special operations against terrorists. It will carry a crew of 360 sailors and 700 combat-ready Marines to be delivered ashore by helicopters and assault craft.

Steel from the World Trade Center was melted down in a foundry in Amite, LA to cast the ship's bow section. When it was poured into the molds on Sept 9, 2003, 'those big rough steelworkers treated it with total reverence,' recalled Navy Capt. Kevin Wensing, who was there.

'It was a spiritual moment for everybody there.'

Junior Chavers, foundry operations manager, said that when the trade center steel first arrived, he touched it with his hand and the 'hair on my neck stood up.' 'It had a big meaning to it for all of us,' he said.. 'They knocked us down.

They can't keep us down. We're going to be back.'

"Operation S.E..R.V.E." is currently working on its non-for-profit status with the government for our Veterans association which will deal primarily with wounded veterans coming back from war. Our plan for their rehab is primarily aqua therapy by specific use of the sport of Scuba diving.

We are planning a kick off event to celebrate the official opening of Operation S.E.R.V,E. on November 14, in a three day event with the final day culminating in a potluck celebratory BBQ. Jesus said, "I am the vine, ye are the branches," and so all believers are "grafted" into a common spiritual heritage with the Jewish people.

Different aspects of the truth of Jesus of Nazareth appeal to different people. For some, the grace and power of his words go straight to their hearts, as John 7:46 says, "... Never man spake like this man." For others, it is fulfilled prophecy that is most impactful. In Acts 2:14-41 the events are recorded of how the apostle Peter used prophecy from the Hebrew Scriptures to testify to a group of Jewish people that Jesus was the Messiah. Three thousand people became believers in Jesus on that day. Prophecy is used by God to bring people to salvation. As much as two-thirds of the Bible is related to prophecy; it is important to God. Fulfilled prophecy shows us the existence of God, that He has a plan, that He is in control, that He is the only God, and that He expects us to study His word.

Jesus says, "Search the Scriptures; for in them ye think you have eternal life: and they are which testify of me," and "Verily, verily, I say unto you, he that heareth my word, and believeth on him that sent me, has everlasting life, and shall not come into condemnation; but is passed from death unto life."

To God's chosen, the Jewish people, this site says that Jesus of Nazareth is your Messiah, the fulfillment of the Hebrew Scriptures:

Jeremiah 31:31
"Behold, the days come, saith the Lord, that I will make a new covenant with the house of Israel, and with the house of Judah."

Matthew 26:28
Jesus says, "For this is my blood of the new testament, which is shed for many for the remission of sins."

In Matthew 5:17-18, Jesus says, "Think not that I am come to destroy the law, or the prophets: I am not come to destroy, but to fulfill. For verily I say unto you, till heaven and earth pass, one jot or one tittle shall in no wise pass from the law, till all be fulfilled." And in Matthew 5:24, Jesus said, "... I am not sent but unto the lost sheep of the house of Israel."

No Knock Entries

Tactical Commanders and SWAT Warriors need to understand the "no-knock" rule as it applies to search warrant service and police response to tactical situations. In the US, a no knock warrant is a warrant issued by a judge that allows law enforcement officers to enter a property without knocking and without identifying themselves as police. It is issued under the belief that any evidence they hope to find can be destroyed during the time that police identify themselves and the time they secure the area.

The Department of Justice writes:

Federal judges and magistrates may lawfully and constitutionally issue "no-knock" warrants where circumstances justify a no-knock entry, and federal law enforcement officers may lawfully apply for such warrants under such circumstances. Although officers need not take affirmative steps to make an independent re-verification of the circumstances already recognized by a magistrate in issuing a no-knock warrant, such a warrant does not entitle officers to disregard reliable information clearly negating the existence of exigent circumstances when they actually receive such information before execution of the warrant.

Should a "no knock" clause be incorporated in a search and arrest warrant or is it justified by the totality of the circumstances at the time of entry? State law usually dictates "no-knock" clauses in search warrants. Thus, if officers plan to make a "no-knock" entry, then the clause should included in the search warrant. However, there are situations, where, even if officer do not have a "no knock" clause, on the search warrant, they may still be permitted to dispense with the general "knock and announce" requirement, at least in accordance with federal Constitutional law.

According to the United States Supreme Court in Hudson v. Michigan, there are situations in which it is not necessary to "knock and announce." For example, it is not necessary when circumstances present a threat of physical violence, if there is reason to believe the giving of notice would lead to the destruction of evidence or if knocking would be futile. The standard of proof for the existence of the above conditions is "reasonable suspicion" under the specific circumstances that may be facing the officers.

Regarding the above rules set forth in Hudson v. Michigan, it is very important to note that this applies under analysis of the Fourth Amendment to the U.S. Constitution. This should be distinguished from any analysis that may be conducted based upon a state's constitution or state statute. States can impose greater restrictions upon law enforcement than is required under federal law. Therefore, officers should consult their prosecutor or department legal advisor for analysis under specific state law.


The Knock And Announce Rule:

A detective rapped on the front door. Then three seconds later, instead of waiting for a resident to answer, one of the officers on his team kicked in the door. They had expected to find a meth lab in the apartment, but the man and woman they awakened in the middle of the night and handcuffed had committed no crimes. The officers had raided the wrong apartment. The couple retained legal counsel and asserted multiple section 1983 claims against the detective, his team of officers, their department, the mayor, and other government officials. 

Section 1983 provides: 

Every person who, under color of any statute, ordinance, regulation, custom, or usage, of any State or Territory or the District of Columbia, subjects, or causes to be subjected, any citizen of the United States or other person within the jurisdiction thereof to the deprivation of any rights, privileges, or immunities secured by the Constitution and laws, shall be liable to the party injured in an action at law, suit in equity, or other proper proceeding for redress.

After extensive litigation, the court of appeals held that the detective was not entitled to qualified immunity. So his failure to ascertain the proper target of the warrant and his failure to follow the knock-and-announce rule jeopardized his career and crippled his personal finances. By understanding the knock-and-announce rule, you can prevent this from happening to you. 

Qualified immunity:

As outlined by the Supreme Court in Harlow v. Fitzgerald qualified immunity is designed to shield government officials from actions "in so far as their conduct does not violate clearly established statutory or constitutional rights of which a reasonable person would have known."

Wrong and Dangerous:

Some police departments have interpreted the Supreme Court's recent Hudson v. Michigan ruling as a license to execute warrants without knocking, announcing, and waiting a reasonable amount of time for a resident to answer the door before entering. That interpretation is both wrong and dangerous.

Let's take a detailed look at the knock-and-announce rule and discuss when and why you can be sued for failing to knock and announce. The requirement that law enforcement officers must knock and announce their presence before entering a residence is not a new rule. Under the common law, police officers could not forcibly enter a residence to execute a search warrant unless they first knocked at the door, identified themselves as officers of the law, articulated their reason for requesting admittance into the home, and were refused admittance. 

This requirement was clarified in the 1995 Supreme Court case Wilson v. Arkansas in which the Court unanimously held that the common law knock-and-announce "principle forms a part of the reasonableness inquiry under the Fourth Amendment." Therefore, "the reasonableness of a search of a dwelling may depend in part on whether law enforcement officers announced their presence and authority prior to entering."

Proponents of the knock-and-announce rule assert that 1) it protects life and limb because a resident may mistake an unannounced police entry for a criminal invasion and brandish a weapon in defense; 2) it protects property by giving the occupant the opportunity to admit the officers; 3) and it protects privacy and preserves dignity by reducing the risk that the police will enter the wrong residence and even when there was no mistake about the place to be searched, permits those within to have a brief notice to prepare for the police entry. For example, if officers knock and announce their presence, a nude resident might have time to don a robe before officers enter his bedroom.

Even when the entry is made without force such as when the door to the residence is not locked or an apartment manager agrees to open the door, you must ordinarily observe the requirement to knock and announce before entering. Some courts have even ruled that you must first announce your presence before entering a wide open door. 

To comply with the notice requirements under the knock-and-announce rule, you must identify yourselves as police and indicate that you are at the home to execute a search warrant. After this announcement is made, you must wait a reasonable time for an occupant of the premises to admit you. If you are denied entry or there is no response from within the residence, you may proceed with a forcible entry if necessary. 

How long of a delay is necessary? The Supreme Court first addressed how much delay is necessary before forcible entry in United States v. Banks. They concluded that a 15- to 20-second wait by the police before they forced the door open with a battering ram was sufficient because the police had reason to believe that if they waited longer, Banks would destroy his suspected stash of cocaine. The officers that executed the search were unaware that Banks was showering when they knocked on the door. The Court reasoned, "The facts known to the police are what count in judging reasonable waiting time."

In addition to destruction of evidence, the Supreme Court has recognized other situations where police do not have to knock and announce: 

  1. Reasonable suspicion of a threat of physical violence to the officers or someone within the residence 
  2. Reasonable suspicion that knocking and announcing would be futile 
  3. Hot pursuit of a fleeing criminal 

To sum up, in Hudson v. Michigan the Supreme Court decided that the exclusionary rule was not an appropriate remedy for a knock-and-announce violation. But let's be clear on this: It did not abolish the knock-and-announce rule. On the contrary, the Court reiterated reasons that the rule should be followed and emphasized that plaintiffs have the right to sue law enforcement officers who violate their constitutional rights. 

The use of this rule is beneficial to law enforcement but the miss use can land you in the hot seat in a Federal court. It's imperative that tactical commanders on the street understand the "no knock rule" and how to apply it in a tactical environment.

Compared to this country, the workmen in Europe and Asia are in a perpetual depression.

And every boy and girl in America has the opportunity to be one of them if he has the native ability and wants to work hard enough—which is true nowhere else in the world. Besides, it was the building of these fortunes which created millions of highly-paid jobs which never would have existed without the hope of profit spurring men on.

"Under capitalism..."

...let's see, that's about all these enemies of capitalism can think up against it. And they're very careful not to remind you that under capitalism and under no other system you have opportunity, you have far more and better food and clothing and recreation than the people of any other nation, and you have freedom.

It's true that headless people don't have headaches, but that's a poor way to cure a headache, isn't it?

    A private security force whose biggest role is helping the U.S. government to "combat terrorism" is now patrolling the streets of a town in Montana, acting as law enforcement but accountable to nobody and operating completely outside the limitations of the U.S. constitution in a chilling throwback to the brownshirts of Nazi Germany.

    Sheriff Joe stripped of ICE agent status

    PHOENIX — An Arizona sheriff known for aggressively cracking down on illegal immigration has been stripped of some of his special power to enforce federal immigration law, and he claims the Obama administration is taking away his authority for political reasons.

    Maricopa County Sheriff Joe Arpaio, whose office faces racial profiling allegations over crime and immigration sweeps in some heavily Latino areas of metro Phoenix, said officials from Washington won't let him renew a deal that let his deputies make federal immigration arrests.

    "Let them all go brag that they took away the sheriff's authority. Let them all do that. That doesn't bother me. I don't have an ego. I will continue doing the same thing," the Republican sheriff said, noting he can still enforce state immigration laws. "What has changed, other than the politics and the perception emanating from Washington?"

    Are we fighting a war on terror or aren't we? Was it or was it not started by Islamic people who brought it to our shores on September 11, 2001 and have continually threatened to do so since?

    Were people from all over the world, not brutally murdered that day, in Downtown Manhattan, across the Potomac from the nation's capitol and in a field in Pennsylvania?

    Did nearly three thousand men, women and children die a horrible, burning or crushing death that day, or didn't they?

    And I'm supposed to care that a few Taliban wer e claiming to be tortured by a justice system of the nation they come from and are fighting against in a brutal insurgency.

    I'll start caring when Osama bin Laden turns himself in and repents for incinerating all those innocent people on 9/11.

    I'll care about the Koran when the fanatics in the Middle East start caring About the Holy Bible, the mere belief of which is a crime punishable by beheading in Afghanistan.

    I'll care when these thugs tell the world they are sorry for hacking off Nick Berg's head while Berg screamed through his gurgling slashed throat.

    I'll care when the cowardly so-called 'insurgents' in Afghanistan come out and fight like men instead of disrespecting their own religion by hiding in Mosques.

    I'll care when the mindless zealots who blow themselves up in search of Nirvana care about the innocent children within range of their suicide bombs.

    I'll care when the Canadian media stops pretending that their freedom of speech on stories is more important than the lives of the soldiers on the ground or their families waiting at home to hear about them when something happens.

    In the meantime, when I hear a story about a CANADIAN soldier roughing up an insurgent terrorist to obtain information, know this:

    I don't care.

    When I see a wounded terrorist get shot in the head when he is told not to move because he might be booby-trapped, you can take it to the bank...

    I don't care.

    When I hear that a prisoner, who was issued a Koran and a prayer mat, and fed 'special' food that is paid for by my tax dollars, is complaining that His holy book is being 'mishandled,' you can absolutely believe in your heart of hearts:

    I don't care.

    And oh, by the way, I've noticed that sometimes it's spelled 'Koran' and other times 'Quran'. Well, Jimmy Crack Corn, you guessed it...

    I don't care!!

    Muslim Gangs Taking Over British Prisons

    The British government's apparent inability to deal with the problems posed by Islamic extremism is being highlighted once again, this time by the news that Muslim gangs are threatening to take control of a high-security jail whose inmates include al-Qaeda-linked terrorists.

    Staff at Whitemoor prison in Cambridgeshire are warning that several wings have become dominated by gangs of Muslim prisoners, and that a "serious incident" is imminent. Between a quarter and one-third of the jail's 500 or so inmates are Muslim, and while most are serving sentences for offenses unrelated to terrorism, they're held alongside extremists like Saajid Badat, who's serving 13 years for plotting with Richard Reid to blow up transatlantic airliners with shoe bombs.

    A report by Prison Service officials identifies an "ongoing theme of fear and instability" among staff at Whitemoor, and says the large number of Muslim inmates appears to be "engendering fear and handing control to the prisoners." The Observer story linked above adds that white prisoners arriving at the jail are routinely warned about the Muslim gangs by staff.

    All of you and those to whom you communicate had better sit up and pay attention; once this sort of thing happens, it will be irreversible.

    The blog will concentrate of my concerns as a retired attorney about the imminent and growing threats to our Constituton and our form of government. We have reason to be very afraid of what is happening.

    THE TRUTH ABOUT THE HEALTHCARE BILLS ?

    Well, I have done it! I have read the entire text of proposed House Bill 3200: The Affordable Health Care Choices Act of 2009. I studied it with particular emphasis from my area of expertise, constitutional law. I was frankly concerned that parts of the proposed law that were being discussed might be unconstitutional. What I found was far worse than what I had heard or expected.

    To begin with, much of what has been said about the law and its implications is in fact true, despite what the Democrats and the media are saying. The law does provide for rationing of health care, particularly where senior citizens and other classes of citizens are involved, free health care for illegal immigrants, free abortion services, and probably forced participation in abortions by members of the medical profession.

    The Bill will also eventually force private insurance companies out of business and put everyone into a government run system. All decisions about personal health care will ultimately be made by federal bureaucrats and most of them will not be health care professionals. Hospital admissions, payments to physicians, and allocations of necessary medical devices will be strictly controlled.

    However, as scary as all of that it, it just scratches the surface. In fact, I have concluded that this legislation really has no intention of providing affordable health care choices. Instead it is a convenient cover for the most massive transfer of power to the Executive Branch of government that has ever occurred, or even been contemplated. If this law or a similar one is adopted, major portions of the Constitution of the United States will effectively have been destroyed.

    The first thing to go will be the masterfully crafted balance of power between the Executive, Legislative, and Judicial branches of the U.S. Government. The Congress will be transferring to the Obama Administration authority in a number of different areas over the lives of the American people and the businesses they own. The irony is that the Congress doesn't have any authority to legislate in most of those areas to begin with. I defy anyone to read the text of the U.S. Constitution and find any authority granted to the members of Congress to regulate health care.

    This legislation also provides for access by the appointees of the Obama administration of all of your personal healthcare information, your personal financial information, and the information of your employer, physician, and hospital. All of this is a direct violation of the specific provisions of the 4thAmendment to the Constitution protecting against unreasonable searches and seizures. You can also forget about the right to privacy. That will have been legislated into oblivion regardless of what the 3rd and 4th Amendments may provide.

    If you decide not to have healthcare insurance or if you have private insurance that is not deemed "acceptable" to the "Health Choices Administrator" appointed by Obama there will be a tax imposed on you. It is called a "tax" instead of a fine because of the intent to avoid application of the due process clause of the 5th Amendment. However, that doesn't work because since there is nothing in the law that allows you to contest or appeal the imposition of the tax, it is definitely depriving someone of property without the "due process of law.

    So, there are three of those pesky amendments that the far left hate so much out the original ten in the Bill of Rights that are effectively nullified by this law. It doesn't stop there though. The 9th Amendment that provides: "The enumeration in the Constitution, of certain rights, shall not be construed to deny or disparage others retained by the people;" The 10th Amendment states: "The powers not delegated to the United States by the Constitution, nor prohibited by it to the States, are preserved to the States respectively, or to the people." Under the provisions of this piece of Congressional handiwork neither the people nor the states are going to have any rights or powers at all in many areas that once were theirs to control.

    I could write many more pages about this legislation, but I think you get the idea. This is not about health care; it is about seizing power and limiting rights. Article 6 of the Constitution requires the members of both houses of Congress to "be bound by oath or affirmation" to support the Constitution. If I was a member of Congress I would not be able to vote for this legislation or anything like it without feeling I was violating that sacred oath or affirmation. If I voted for it anyway I would hope the American people would hold me accountable.

    Report of 1955 jet wreckage found stirs memories

    LOS ANGELES – A historian's reported discovery of the wreckage of an Air Force jet lost at sea 54 years ago off the Southern California coast brought an unexpected surge of emotions for the pilot's brother, who found himself grieving all over again.

    Aviation archaeologist G. Pat Macha said Tuesday that he and a group of volunteers found Richard Martin Theiler's plane underneath 100 feet of water earlier this month. Theiler was in the front seat of the Lockheed-Martin T-33A that went missing just after takeoff from the Los Angeles International Airport on Oct. 15, 1955.

    "He was five years older than me, a good athlete and everyone loved him, so there was a lot of hero worship involved," said Thomas Theiler, 77, who followed his older brother into the Air Force. He now lives in Savannah, Ga. "He probably got his wings two years before I did. We were buddies."

    Reporting from Washington - The Supreme Court's decision Wednesday to hear a 2nd Amendment challenge to Chicago's handgun ban could open the door to similar lawsuits in cities and states across the nation.

    At issue is whether the right to keep and bear arms is a full-fledged constitutional privilege that can be invoked by individuals against the government at all levels, or a freedom that applies only as it concerns the federal government.

    Last year, the justices in a 5-4 ruling said for the first time that the 2nd Amendment protected an individual's right to have a handgun at home for self-defense. Though that ruling struck down a handgun ban in the nation's capital -- which is a federal enclave -- it did not decide whether the right extended to states and cities.

    America armed, but guns not necessarily loaded

    NEW ORLEANS – Bullet-makers are working around the clock, seven days a week, and still can't keep up with the nation's demand for ammunition.

    Shooting ranges, gun dealers and bullet manufacturers say they have never seen such shortages. Bullets, especially for handguns, have been scarce for months because gun enthusiasts are stocking up on ammo, in part because they fear President Barack Obama and the Democratic-controlled Congress will pass antigun legislation — even though nothing specific has been proposed and the president last month signed a law allowing people to carry loaded guns in national parks.

    Gun sales spiked when it became clear Obama would be elected a year ago and purchases continued to rise in his first few months of office. The FBI's National Instant Criminal Background Check System reported that 6.1 million background checks for gun sales were issued from January to May, an increase of 25.6 percent from the same period the year before.

    "That is going to cause an upswing in ammunition sales," said Larry Keane, senior vice president of the National Shooting Sports Foundation, a trade association representing about 5,000 members. "Without bullets a gun is just a paper weight."

    Empire State Building lit for China, drawing ire

    NEW YORK – Red and yellow lights shone from the top of the Empire State Building at dusk Wednesday, a tribute to communist China's 60th anniversary that protesters labeled "blatant approval" of totalitarianism and criticized as inappropriate for an icon in the land of the free.

    The building is routinely lit with different colors to mark holidays and big events, but opponents questioned whether it's right to commemorate a sensitive political issue, particularly when China has such a poor human rights record.

    About 20 supporters of Tibet, which China has ruled since shortly after communists took over in 1949, protested outside the building during a ceremonial lighting of a scale model inside the lobby. They chanted "No to China's empire; free Tibet now," and held signs reading, "Empire State Building celebrating 60 years of China's oppression."

    Somali pirates attack French military flagship

    NAIROBI (AFP) – Somali pirates attempted to storm the French navy's 18,000 tonne flagship in the Indian Ocean after mistaking it for a cargo vessel, the French military said on Wednesday.

    The crew of La Somme, a 160-metre (525-foot) command vessel and fuel tanker, easily saw off the brazen night-time assault by lightly armed fighters on two lightweight skiffs and captured five pirates, a spokesman said.

    "The pirates, who because of the darkness took the French ship for a commercial vessel, were on board two vessels and opened fire with Kalashnikovs," Admiral Christophe Prazuck said in Paris.

    La Somme is the French command vessel in the Indian Ocean, overseeing French air, sea and land forces fighting Somali pirates and hunting terrorists under the banner of the US-led Operation Enduring Freedom.

    California's Ammo Bill AB962 Will End Federal CMP Program

    GunNewsDaily.com Alert Notification 9-12-09 - The California legislature recently passed AB962, a bill that severely restricts ammunition sales in the state of California.

    One very little known fact about this bill is that it will effectively override federal law.

    In 1996 a federal law created the Civilian Marksmanship Program (CMP) with the specific mission to promote firearms and marksmanship training for U.S. citizens with an emphasis on youth programs. This program provides firearms, most notably M1 Garands to affiliated CMP organizations. Additionally, it provides 22-caliber ammunition, air rifle pellets and BBs, which are suitable for youth firearms training and rifle marksmanship programs. AB962 would effectively end the transfer of ammuntion from CMP to various organizations that either take advantage or are eligible, such as Boy Scouts of America, Junior ROTC units, 4-H shooting sports clubs and many other California organizations.

    This bill is now on the governor's desk awaiting his signature or veto. It is important that he veto it. But, to do that, you need to contact your federal representative in Congress. Write them an email explaining why the governor should veto this bill. It is not the job of California politicians to override federal statutory law, specifically Title 36 U.S. Code 40701-40733. The Congressional delegation of the House needs to know about this so they can contact Governor Schwarzenegger's office and file their complaints directly to him.

    I urge each of you to take action to stop this bill. He may or may not sign it, but to make sure he thinks about it long and hard and understands the implications of his approval of this bill, please contact your federal representative today and make your voice heard.

    450 Mayors Petition Obama To Adopt Broad Gun Reform

    A new report from a national coalition of mayors urges President Obama to adopt dozens of reforms to help curb gun violence, including steps to crack down on problems at gun shows and the creation of a federal interstate firearms trafficking unit.

    The "Blueprint for Federal Action on Illegal Guns," a copy of which was obtained by The Washington Post, presents 40 recommendations that "would dramatically improve law enforcement's ability to keep guns out of the hands of criminals -- and, in doing so, save innocent lives."

    The strategies outlined by the Mayors Against Illegal Guns, a bipartisan group of about 450 mayors nationwide, focus on the federal Bureau of Alcohol, Tobacco, Firearms and Explosives. The agency, which has been sent a copy of the report, declined to comment.

    "Implementing these recommendations would achieve a goal that all participants in the gun debate support: enforcing laws already on the books," says an accompanying letter signed by the coalition's co-chairmen, Mayors Thomas M. Menino (D) of Boston and Michael R. Bloomberg (I) of New York.

    Qaida Man Hid Bomb in His Ass

    Al-Qaida has adopted a technique from drug smugglers that allows suicide bombers to breach even the tightest security. One of the terrorists who tried to assassinate a Saudi prince hid explosives and detonator in his rectum.

    Abdullah Asieri avoided detection by two sets of airport security and palace security, in his mission to eliminate prince Mohammed Bin Nayef, head of Saudi Arabia's counter terrorism operations. Taking a trick from the narcotics trade - which has long smuggled drugs in body cavities - Asieri had a pound of explosives, plus a detonator inserted in his rectum, reports CBS News.

    The bomber persuaded the prince he wanted to leave al-Qaida, setting a trap. Al-Qaida has an animated movie showing the meeting between the bomber and the prince. Asieri says more senior Qaida figures want to surrender and convinces the prince to talk to them on a cellphone.

    In the conversation recorded by al-Qaida, one can hear a beep in the middle of two identical phrases that are repeated by the bomber and his handler. Explosives experts told CBS News that beep was likely a text message activating the bomb concealed inside Asieri. The Trojan bomber hands the phone to the prince. He's standing next to him, and 14 seconds later, he detonates.

    A mai tai with the Mai Mai?

    KINSHASA (Reuters) – Congo's army has suspended an officer accused of drinking with the enemy ahead of a militia attack that the United Nations said left six soldiers dead, a top army commander said Tuesday.

    Local Mai Mai militia fighters attacked an army camp in the town of Nyamilima, near Democratic Republic of Congo's eastern border with Uganda, early Sunday.

    The army's head of operations in North Kivu province said Nyamilima's battalion commander, known as Major Leon, was suspended for negligence in the execution of his functions.

    "He was drinking in the camp with the Mai Mai that then came and attacked," Colonel Bobo Kakudji told Reuters.

    Maria Gulovich Liu dies at 87; helped American agents during WWII

    She joined the underground resistance in Slovakia and helped several U.S. and British intelligence agents evade the Germans while fleeing to safety.

    Maria Gulovich Liu, who as a young schoolteacher in Slovakia during World War II joined the underground resistance as a courier and later helped a small group of American and British intelligence agents evade the German Army as they fled through the frigid mountains to safety, has died. She was 87.

    Liu, who received a Bronze Star for her "heroic and meritorious" service to the Office of Strategic Services, died of colon cancer Friday at her home in Port Hueneme, said Jim Downs, a family friend.

    Two Special Forces Soldiers killed in the southern Philippines

    FORT BRAGG, N.C. (USASOC News Service, Oct. 1, 2009) – Two U.S. Special Forces Soldiers died when their vehicle struck an improvised explosive device Sept. 29 on Jolo Island, Philippines.

    The following Soldiers, both assigned to 3rd Battalion, 1st Special Forces Group (Airborne) headquartered at Fort Lewis, Wash. They were in the Philippines supporting Operation Enduring Freedom.

    Army Ranger killed in action

    U.S. Army Special Operations Command Public Affairs Office

    FORT BRAGG, N.C. (USASOC News Service, Oct. 3, 2009) — An Army Ranger died Oct.1 from wounds received during combat operations in Afghanistan while serving with Company B, 1st Battalion, 75th Ranger Regiment based at Hunter Army Airfield, Ga.

    Sgt. Roberto Daniel Sanchez, 24, was killed in Kandahar Province, Afghanistan during a combat operation involving multiple enemy contacts that killed nine enemy combatants and destroyed a large weapons cache. During the operation Sanchez was mortally wounded by an enemy improvised explosive device.

    "Sgt. Sanchez epitomized the spirit and ethos of the Ranger Regiment," said Col. Michael E. Kurilla, commander of the 75th Ranger Regiment. "He is a hero to our Nation, our Army and his family."

    Life of Green Beret remembered by teammates, unit

    5th Special Forces Group (Airborne) Public Affairs Officer

    Fort Campbell, KY (USASOC News Service, Sept. 24, 2009) – As Americans across the nation woke to a day of remembrance on Sept. 11, Staff Sgt. Shane Angell ran a 12-mile road march and graduated Air Assault School on Fort Campbell, Ky. It was just another day of training for the second-generation Green Beret.

    Later that day, during a motorcycle ride on Kentucky Highway 100, about six miles outside of Russellville, Ky., Angell collided with another vehicle.

    The 26-year-old died instantly of injuries sustained in the crash.

    Memorial Service for Shifty

    We're hearing a lot today about big splashy memorial services.

    I want a nationwide memorial service for Darrell "Shifty" Powers.

    Shifty volunteered for the airborne in WWII and served with Easy Company of the 506th Parachute Infantry Regiment, part of the 101st Airborne Infantry. If you've seen Band of Brothers on HBO or the History Channel , you know Shifty. His character appears in all 10 episodes, and Shifty himself is interviewed in several of them.

    I met Shifty in the Philadelphia airport several years ago. I didn't know who he was at the time. I just saw an elderly gentleman having trouble reading his ticket. I offered to help, assured him that he was at the right gate, and noticed the "Screaming Eagle," the symbol of the 101st Airborne, on his hat.

    Making conversation, I asked him if he'd been in the 101st Airborne or if his son was serving. He said quietly that he had been in the 101st. I thanked him for his service, then asked him when he served, and how many jumps he made.

    Quietly and humbly, he said "Well, I guess I signed up in 1941 or so, and was in until sometime in 1945..." at which point my heart skipped.

    At that point, again, very humbly, he said "I made the 5 training jumps at Toccoa, and then jumped into Normandy... do you know where Normandy is?" At this point my heart stopped.

    I told him "yes, I know exactly where Normandy is, and I know what D-Day was." At that point he said "I also made a second jump into Holland, into Arnhem." I was standing with a genuine war hero... and then I realized that it was June, just after the anniversary of D-Day..

    I asked Shifty if he was on his way back from France , and he said "Yes. And it's real sad because, these days, so few of the guys are left, and those that are, lots of them can't make the trip." My heart was in my throat and I didn't know what to say.

    I helped Shifty get onto the plane and then realized he was back in Coach while I was in First Class. I sent the flight attendant back to get him and said that I wanted to switch seats. When Shifty came forward, I got up out of the seat and told him I wanted him to have it, that I'd take his in coach.

    He said "No, son, you enjoy that seat. Just knowing that there are still some who remember what we did and who still care is enough to make an old man very happy." His eyes were filling up as he said it. And mine are brimming up now as I write this.

    Shifty died on June 17, 2009 after fighting cancer.

    There was no parade.
    No big event in Staples Center.
    No wall to wall back to back 24x7 news coverage.
    No weeping fans on television.
    And that's not right.

    Let's give Shifty his own Memorial Service, online, in our own quiet way. Please forward this email to everyone you know. Especially to the veterans.

    Gaylord Campbell dies at 81; U.S. marshal served subpoenas on Nixon

    President Nixon appointed him to the marshal's post for Southern California in 1969. In 1974, Campbell had to serve the two subpoenas on Nixon at his San Clemente home.

    Gaylord L. Campbell, a U.S. marshal who was appointed by President Nixon and then served two subpoenas on him dealing with the Watergate scandal, has died. He was 81.

    Campbell died Thursday at Tarzana Health and Rehabilitation Center, said his daughter, Gayle Campbell Hughes. He had colon cancer.

    Campbell was Los Angeles County Sheriff Peter J. Pitchess' most visible public information officer when he was appointed by Nixon in 1969. Campbell's jurisdiction included Los Angeles, Orange, Riverside, San Bernardino, Santa Barbara, San Luis Obispo and Ventura counties.
